Terms of Service

These Terms of Service explain the rules that apply when you purchase or use products and services offered through UX Growth.

UX Growth is operated by Nicholas Mann, a sole proprietor based in Washington State.

By purchasing a product or service from UX Growth, you agree to these Terms and the Privacy Policy. Please read them before purchasing.

  1. What UX Growth provides

    UX Growth provides educational resources, portfolio guidance, portfolio writing and rewriting services, and related career-portfolio support for UX and product designers.

    The specific deliverables included in your purchase are defined by the applicable sales page, checkout description, approval email, or written project confirmation in effect when you purchase.

    Purchasing one service does not include work offered under another service unless that additional work is specifically included in writing.

    UX Portfolio Strategy Kit

    The UX Portfolio Strategy Kit is a self-guided digital product containing educational materials, templates, examples, and resources designed to help you improve your own portfolio and case studies.

    The Strategy Kit does not include personalized portfolio review, individual feedback, custom writing, implementation, or ongoing support unless separately stated.

    UX Case Study Guidance

    UX Case Study Guidance is a personalized service designed to help you improve one UX case study while you remain responsible for writing and implementing the final case study.

    The service includes the guidance and feedback described on the Guidance sales page at the time of purchase. It is not a done-for-you rewrite, website implementation service, or unlimited consulting arrangement.

    The three-week service window begins only after your completed intake and required project materials have been received and confirmed by UX Growth. You will receive confirmation of the service timing before the work begins.

    Portfolio Rewrite Services

    Portfolio rewrite services are personalized writing and positioning services.
    Depending on the service purchased, work may include homepage messaging, value proposition copy, project titles and previews, case-study rewrites, About-page copy, visual structure guidance, and interview or presentation materials.

    The exact scope of your project is the scope described in your approved offer.
    Portfolio rewrite services do not include website development, Squarespace implementation, Figma design work, visual redesign, unlimited consulting, general career coaching, job placement, or deliverables outside the purchased scope unless separately agreed in writing.

  2. Payment and starting the work

    Payment is required before paid service work begins.
    For personalized services, payment reserves your place in the service process. The working timeline begins only after UX Growth has received the information, materials, intake responses, scheduling information, and other inputs required to perform the work.

    If required materials are incomplete or delayed, the project timeline may also be delayed.

    Any estimated completion date assumes that you respond to requests and provide required materials within a reasonable amount of time.
    Applicable taxes may be added where required by law.

  3. Your responsibilities

    You are responsible for providing accurate information about your work, responsibilities, projects, results, employment history, metrics, and other portfolio content.

    UX Growth will not knowingly create fabricated accomplishments, fake metrics, misleading claims, or false descriptions of your role.
    You are responsible for reviewing final materials for factual accuracy before publishing or using them.

    You must also have the right to share any materials you provide to UX Growth. This includes screenshots, employer information, research, internal documents, client work, metrics, and other potentially confidential material.
    Do not provide information that you are prohibited from sharing.

  4. Confidential and NDA-restricted material

    UX Growth will treat client materials as private and will not publicly publish identifiable client work, before-and-after examples, confidential project information, or other client materials without permission.

    However, an NDA or confidentiality agreement between you and your employer, client, or another third party does not automatically bind UX Growth.

    You remain responsible for understanding your confidentiality obligations and for removing or redacting information that you are not permitted to share.

    If your work requires UX Growth to sign a separate NDA before reviewing certain materials, contact UX Growth before submitting those materials.

  5. Scheduling and rescheduling

    For services that include a scheduled call, please provide at least 24 hours' notice when you need to reschedule.

    A call may be rescheduled once without penalty when reasonable notice is provided.

    Late cancellations, repeated rescheduling, or missed calls may delay the service and are subject to availability. Reasonable exceptions may be made for emergencies.

    If UX Growth needs to reschedule a call, you will be offered another available time.

  6. Revisions and additional work

    Portfolio rewrite services include one consolidated revision round unless the purchased offer specifically states otherwise.

    Revision feedback should focus on factual accuracy, clarity, emphasis, alignment with your experience, and reasonable adjustments to the agreed deliverables.

    A revision does not include new pages, additional case studies, new deliverables, a change in project direction, unlimited preference changes, or work that was not part of the original scope.

    Additional work may require a separate agreement and additional payment.
    Guidance services include only the feedback and follow-up described in the Guidance offer. They do not create an unlimited revision or support period.

  7. Refund and cancellation policy

    UX Portfolio Strategy Kit
    Because the Strategy Kit is a digital product that can be accessed after purchase, purchases are generally non-refundable once access to the files has been provided.

    A refund may be provided for a duplicate purchase, a technical problem caused by UX Growth that prevents access and cannot reasonably be corrected, or when required by applicable law.

    UX Case Study Guidance
    If UX Growth reviews your information and determines before the live Guidance call that the service is not an appropriate fit for your situation, your purchase will be canceled and you will receive a full refund.

    You may also request a full cancellation and refund before the scheduled call, provided the request is made at least 24 hours before the call.
    Once the live Guidance call begins, the service is considered to have started and the purchase is generally non-refundable.

    If UX Growth is unable to provide a material part of the service that was promised, UX Growth will first make a reasonable effort to complete or correct the service. When that is not possible, an appropriate full or partial refund may be issued.

    Portfolio Rewrite Services
    You may cancel a portfolio rewrite service for a full refund before custom work begins.

    Once individualized strategy, analysis, writing, rewriting, or other custom work has begun, the service is generally non-refundable because the work is created specifically for you and delivery capacity has been reserved for your project.

    If UX Growth cannot complete the agreed service, you will receive a refund for any material portion of the purchased work that cannot be delivered.
    Nothing in this policy removes refund or cancellation rights that cannot legally be waived.

  8. Client delays and abandoned projects

    UX Growth needs your participation to complete personalized services.
    If you stop responding, fail to provide necessary information, or substantially delay required feedback, the project may be paused.

    A paused project does not guarantee that the original completion date or scheduling availability can be preserved.

    UX Growth will make a reasonable effort to contact you before treating a project as inactive. Restarting an inactive project may depend on current availability.

  9. Payment plans and Klarna

    Some purchases may offer installment or buy-now-pay-later options through third-party payment providers such as Klarna.

    Approval, eligibility, installment schedules, payment collection, and provider-specific terms are controlled by the payment provider, not UX Growth.
    Choosing an installment option does not change the scope, refund policy, or client responsibilities associated with the service.

    When UX Growth approves a refund for a purchase made through an installment provider, the refund will be initiated through the original payment system. The payment provider controls how and when that adjustment appears on your installment account.

  10. Ownership and permitted use

    You retain ownership of the original portfolio materials, project information, writing, images, and other content you provide to UX Growth.

    You give UX Growth permission to use those materials only as reasonably necessary to provide the product or service you purchased.

    After full payment, you may use, edit, adapt, publish, and reuse custom portfolio copy and other individualized deliverables created for you as part of the purchased service.

    UX Growth retains ownership of its pre-existing frameworks, methods, templates, educational materials, systems, processes, examples, and general know-how.

    Materials included in the UX Portfolio Strategy Kit are licensed to the purchaser for their own personal and professional use. They may not be resold, redistributed, republished as another product, shared publicly as downloadable files, or represented as your own commercial resource.

  11. Testimonials and portfolio examples
    Purchasing a paid service does not require you to provide a testimonial or allow your work to be used for marketing.

    UX Growth may ask for feedback, a testimonial, or permission to show a before-and-after example after the work is completed.
    Identifiable client work will not be publicly presented as a client example without separate permission.

    Permission to use a testimonial or example may be limited or withdrawn for future use by contacting UX Growth, subject to materials that have already been published or distributed.

  12. No employment or hiring guarantee
    UX Growth helps improve how your experience, decisions, work, and portfolio story are communicated.

    UX Growth does not control hiring managers, recruiters, employers, job markets, application decisions, interview decisions, compensation decisions, or employment offers.

    No product or service guarantees an interview, job offer, promotion, salary increase, career outcome, or specific response from an employer.
    You remain responsible for your job search, applications, interviews, career decisions, and how you ultimately use the materials provided.

  13. Third-party services
    UX Growth uses third-party platforms to operate parts of the business, which may include payment processing, website hosting, email, scheduling, forms, file sharing, and document collaboration.

    Those platforms have their own terms, privacy practices, availability, and technical limitations.

    UX Growth is not responsible for a third-party platform outage or decision that is outside UX Growth's reasonable control, but will make reasonable efforts to provide an alternative when a platform issue materially prevents delivery of a purchased service.

  14. Service refusal and termination

    UX Growth may decline or stop providing a service when necessary, including when a client requests false or misleading claims, repeatedly expands the agreed scope, behaves abusively, provides material that cannot legally be used, or otherwise makes completion of the agreed service unreasonable.
    When UX Growth ends a project for reasons unrelated to client misconduct or breach of these Terms, any appropriate refund for undelivered work will be provided.

  15. Limitation of liability

    To the fullest extent permitted by applicable law, UX Growth will not be responsible for indirect, incidental, special, or consequential losses arising from the use of its products or services, including lost employment opportunities, lost income, or decisions made by employers or other third parties.

    To the fullest extent permitted by applicable law, UX Growth's total liability relating to a specific purchase will not exceed the amount you paid UX Growth for that purchase.

    Nothing in these Terms limits liability or consumer rights that cannot legally be limited.

  16. Changes to these Terms
    UX Growth may update these Terms as the business, services, or legal requirements change.

    Changes apply to future purchases after the updated Terms are posted.
    For an existing paid service, the version of the Terms in effect when you purchased will continue to govern that purchase unless you and UX Growth agree otherwise.

  17. Governing law
    These Terms are governed by the laws of the State of Washington, except where applicable consumer law requires otherwise.

    Before starting a formal dispute, you are encouraged to contact UX Growth so there is an opportunity to resolve the issue directly.
